Her legal representatives had initially submitted an application to the U.S. Patent and Trademark Office (USPTO) to secure trademark rights for a variety of products, including cooking aprons, jams, dog biscuits, and a line of clothing. However, the USPTO partially rejected the request, issuing a 145-page decision citing the risk of confusion between the two trademarks. The key reason for the rejection was the close similarity in both the pronunciation and visual appearance of the two brand names, which the USPTO determined could mislead consumers.

The Chinese clothing company at the center of the dispute is a major supplier to well-known retailers such as H&M and other fashion outlets. Because of this, the USPTO ruled that allowing Megan’s brand to market clothing under the same name would create a likelihood of consumer confusion, making it difficult to differentiate between the two brands. In response to this decision, Megan and her legal team made strategic modifications to their trademark application. In January 2024, they revised the scope of the brand by removing clothing from its list of products. This amendment allowed the As Ever trademark to gain approval, albeit for a more limited range of items.
